ARTICLE 1: Object

These General Terms of Use (hereinafter referred to as the “GTU”) provide a legal framework for the use of the website « neb-online.fr » (hereinafter referred to as “the Site”) and its services.

This contract is concluded between:

The operator of the Site (hereinafter referred to as “the Publisher” or “NEB”), and

Any natural or legal person wishing to access the Site and its services (hereinafter referred to as “the User”).

The GTU shall be accepted by any User, and the access and use of the Site imply the User’s acceptance without reservation of the GTU.

The Site is accessible from the Internet at the following address: https://www.neb-online.fr/.

The User has access to the following services:

  • Discover NEB, its products & applications as well as the customized services it offers;
  • Keep up to date with the latest news about NEB and its field of activity;
  • Consult the catalog and documentation available online;
  • Order products via the online store;
  • Participate in games and contests to try to win gifts.

Any User with access to an Internet network may access the Site free of charge from anywhere. NEB does not bear the costs incurred by the User to access the Site (internet connection, computer equipment, etc.).

The following services are only accessible to the User if he/she is a member of the Site (i.e. he/she has identified him/herself using his/her login details):

  • Order products via the online store.

These lists are non-exhaustive and may be modified at any time by NEB without NEB being held liable in this respect.

It is understood that NEB reserves the right to modify, at any time and without prior notice, the information appearing on the Site, in particular that relating to the characteristics of the products presented.

The Site and its various services may be interrupted or suspended by NEB, in particular for maintenance purposes, without any obligation to give prior notice or justification.

 

ARTICLE 4: Liability of the User

The User agrees to use the Site in accordance with national and international regulations.

In particular, the User agrees to:

  • To read carefully the GTU and to comply with them;
  • Not to reproduce, even temporarily and/or partially, the Site by any means and in any form;
  • Not to access and/or use the software components of the Site;
  • Not to export the Site and/or merge it with other computer programs;
  • Inform NEB if he/she becomes aware of any piracy and/or illicit or non-contractual use of the Site;
  • Not to carry out any manipulation and/or introduce any virus or malicious code that could lead to computer and/or functional breakdowns that could affect the proper functioning of the Site;
  • Not to hinder the proper functioning of the Site by any means whatsoever.

The User is responsible for the risks related to the use of his/her login and password.

The User’s password must remain secret. In the event of disclosure of the password, NEB declines all responsibility.

The User shall assume full responsibility for the use he/she makes of the information and content on the Site.

Any use of the service by the User resulting directly or indirectly in damage must be compensated for by the Site.

 

ARTICLE 5: Liability of the Publisher

5.1 For the site use

NEB shall implement all necessary means to secure access, consultation and use of the Site.

The Site is accessible on a continuous basis, except in the event of force majeure or the occurrence of an event beyond NEB’s control, and subject to any breakdowns and maintenance operations necessary for the proper functioning of the Site.

NEB cannot be held responsible for any malfunction of the server or the network.

Similarly, NEB cannot be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

NEB reserves the right not to guarantee the reliability of the sources, although the information published on the Site is deemed reliable.

NEB reserves the right to modify, at any time and without notice, the information on the Site.

Access to and use of the Site are at the User’s own risk. It is the User’s responsibility to take all appropriate measures to protect his/her own data and/or software stored on his/her telephone and computer equipment against any attack.

In any case, NEB will not be liable:

  • In the event of non-compliance by the User with these GTU;
  • In the event of malfunction of the Site due to a cause, whether voluntary or involuntary, that is attributable to the User or to a third party or to an act of malice, software, the smartphone/tablet, an interface or any other product or supply of the User;
  • In the event of malfunction and/or failure of the User’s computer and/or communication network, whatever the cause.

NEB does not guarantee that the Site is free of any error or anomaly, nor that it may be subject to attacks, in particular by viruses, which may lead to malfunctions, interruptions, breakdowns or losses of data or information.

 

5.2 For information on products and services

The characteristics of the products and services presented in the catalog on the Site are those existing at the time they are put online on the Site, as distributed in metropolitan France, they are given for information purposes only and cannot be considered as a contractual offer of products from NEB.

 

ARTICLE 6: Intellectual Property

The contents of the Site (logos, texts, graphic elements, videos, etc.) are protected by copyright under the Intellectual Property Code.

The User must obtain NEB’s authorization before reproducing, copying or publishing any of this content.

The latter may be used by users for private purposes, provided that they comply with the provisions of Article L.122-5 of the Intellectual Property Code; any commercial use is prohibited.

The User is entirely responsible for any content he/she puts online and undertakes not to harm any third party.

NEB reserves the right to moderate or delete content posted by Users at any time, without justification.

 

ARTICLE 7: Personal data

The use of the Site may require the processing by NEB of personal data allowing direct or indirect identification of the User.

Thus, the User must provide personal data in order to register on the Site.

The User’s electronic address (e-mail) may be used by the Site to communicate various information and manage the account.

ARTICLE 8: Links

NEB is not responsible for the domains to which the hypertext links on the Site lead and has no control over these links.

It is possible for a third party to create a link to a page of the Site without the express authorization of NEB.

 

ARTICLE 9: Update of the GTU

The Site reserves the right to modify and update the provisions of these GTU at any time and without justification.

If necessary, the modifications and updates will be binding on the User as soon as they are published on the Site, and the User is responsible for consulting the current GTU at each connection to the Site.

 

ARTICLE 10: Duration of the GTU

The duration of these GTU is indefinite. The GTU are effective for the User from the beginning of the use of the Site.

 

ARTICLE 11: Applicable law and jurisdiction

The Site and the GTU are subject to French law.

Any dispute that may arise concerning the validity, interpretation and/or execution of these GTU must be the subject of an attempt at amicable settlement.

In the absence of an amicable settlement, any dispute will be submitted to the exclusive jurisdiction of the Commercial Court of Evry, including in the event of summary proceedings, appeal in warranty or multiple defendants.
